Description
The system of the temporal terms and the system of the indications. A laical law system would be only the one which refuses the will to express a superior order of values for the society. The law distinguished by the ethics is a law purely functional, founded on the balance between costs and benefits. In this perspective must be reconsidered also the law about abortion and medically assisted procreation (map), that, differently by the abortion, doesn’t involve a problem of protection of the victim, because it doesn’t cause an harm to a socially valuable form of life, so that the criminalization is still more difficult for the absence of a specific law good or legal interest to protect. Instead the evaluation about benefits and costs is needed for the abortion, because it involves not only the problem of the protection of life, but it is needed to consider also the eventual conflict between protection of life from one hand and the right to self-determination of the woman in order to the choices about pregnancy, from the other hand.
