Description
The activities of the research unit of Campobasso, framed within that broader aimed at checking whether the frame reference in which to place the development of European Law can be found not just in terms of a "market only "but now also a" European citizenship ", are directed to analyze some of the key components that could allow such a evolution. In particular studying the current level of protection of individual rights, family relations and labor relations and their possible future lines of development, means to highlight some of the basic qualifications composing the subjective status complex known under the name of "European citizenship", considered as a condition of subjectivity in addition to national identity. In particular, therefore, the reconnaissance of rules aimed at governing and protecting specific figures subjective (individuals, member of a family, worker) poses as a basis for a wide-ranging research aimed at verifying that the current degree of harmonization of european the law is not simply aimed at creating a common commercial space in which could move freely the four flows (persons, goods, services, capital)as a first objective of the European Community, but has evolved now directly addressing the people who make up the human substrate, electing them as interlocutors to the EU.
The first phase of research (which, in coorence with guidelines dictated by the scientific coordinator of the project, will occupy the first 6 / 8 months) will be directed to a broad and thorough research in the areas identified above, considering them among the multiple manifestations of " European Law", analizing both at Community and national level, legislative, judicial and doctrinal materials.
This reconstruction will be aimed at verifying that the development of such sectors of European Law are respectful of the values dictated cornerstone for European citizenship and identified in the principles of freedom, equality, solidarity, justice, and dignity or if they are simply addressed to the achieve a more effective and efficient European economic integration.
The second phase will occupy the remainder of the project and will be addressed to see if the desired change from "single market" to "European citizenship", as a fundamental value action bodies, can scan and guide further action same in the areas under study, namely whether a Europeanization of private law could promote further harmonization of law in the areas covered by the study of research.
